Mr. McQueeney’s article “Should Naturally Occurring Substances, Such as Asbestos or Diacetyl, Be Subject to Design Defect Claims?” was published in the DRI’s The Voice-This Week’s Feature on February 5, 2014.
Mr. McQueeney argues that no person or entity designs substances that occur naturally but are sold and distributed commercially. Therefore, they should not be subject to design defect claims. Allowing plaintiffs to make such claims provides an avenue to recovery, in many cases multi-million dollar verdicts that are neither scientifically valid nor legally sound.
