On October 12, 2011, Associate Elaine C. Davenport received a Defense Verdict in a personal injury suit stemming from a head-on motor vehicle collision. The trial took place in the State Court of Cook County. The Plaintiff alleged that the Defendant, traveling in the opposite direction, moved her vehicle into Plaintiff’s lane of traffic causing a head-on collision. Defendant argued that the Plaintiff was the cause of the accident, and at the very least, that Plaintiff did not meet her burden of proof on showing how the accident actually occurred. The Plaintiff submitted medical bills to the jury and asked for an award of $50,000.00, the maximum allowed in the Municipal division. After two hours of deliberation, the jury returned with a defense verdict of only $2,453.45.
