On September 6, 2018, Brian H. Sanchez won a decision in the Third District Appellate Court, which affirmed summary judgment granted in favor of an insurer in a property loss claim. The plaintiff had sustained damage to its premises when an underground water line was damaged and caused water to flow into the premises. The insurer denied coverage based on an exclusion for loss caused by water below the surface of the ground. Plaintiff filed suit alleging breach of contract and bad faith, arguing that the exclusion only applied to damage caused below the ground. The trial court granted summary judgment in favor of the insurer on both claims. The appellate court affirmed, finding the exclusion for loss caused by water below the surface of the ground applied.
