Ryan McQueeney obtained an order for summary judgment on behalf of a large retail chain headquartered in Illinois. The case was brought by a single plaintiff who alleged that she was injured by a floor cleaning machine left unaccompanied in an aisle of one of the company’s stores. The motion argued that all three counts plaintiff brought against the company – negligence, res ipsa loquitur and spoliation of evidence – should be dismissed as a matter of law. The order granted by the Honorable Daniel T. Gillespie disposes of all claims brought by the plaintiff against the company.
