Partner Gerald Dombrowski represented a restaurant owner in a false arrest and malicious prosecution claim stemming from an incident in Berwyn, Illinois. The Plaintiff asserted that the restaurant owner’s employee assisted the police officers in the false arrest and malicious prosecution of the Plaintiff who initially claimed he was entitled to a free meal at the restaurant. After a disturbance, the Plaintiff was issued an ordinance violation for disorderly conduct.
After extensive motion practice in the U.S. District Court for the Northern District of Illinois and Cook County Circuit Court, Mr. Dombrowski was successful in obtaining a dismissal with prejudice before Cook County Judge Kathy Flanagan. The Plaintiff then appealed to the Illinois First Appellate District and that Court affirmed the dismissal of the Plaintiff’s complaint in December 2014.
