Leo Dombrowski defends and counsels clients in a wide variety of toxic tort and environmental, health and safety matters, including environmental aspects of corporate and real estate transactions. He has represented companies, developers, municipalities, and individuals in numerous enforcement and other proceedings in federal and state courts and agencies, including the US EPA, Illinois EPA, and Illinois Pollution Control Board. He has also successfully defended clients in several high-profile, precedent-setting environmental citizens suits. Mr. Dombrowski has also represented shooting ranges in suits brought under various environmental laws and counseled numerous entities, including the Federal Bureau of Investigation, regarding environmental, health and safety laws applicable to shooting ranges.

In pro bono matters, he has represented several military veterans before the US Court of Appeals for Veterans Claims and Board of Veterans Appeals in their efforts to obtain benefits from the VA.

NOTABLE EXPERIENCE

  • Successfully defended high-profile, high-stakes citizen suit from trial court level to the US Supreme Court, which set an important precedent favorable to industry. The lawsuit, brought by an environmental organization against a steel pickling company, alleged the company had failed to file certain reports with the government. Reversing the 7th Circuit, the Supreme Court held that the environmental group did not have constitutional standing to bring the case.
  • Won jury verdict on behalf of chemical company in an action brought by pipefitter alleging he had contracted mesothelioma from exposure to asbestos. Following an eight–day trial, the jury found in favor of the defense, rejecting the plaintiff’s claim for over $6 million in damages.
  • Successfully represented a municipality before the Illinois Pollution Control Board and Appellate Court in appeal of the denial of a request for local siting approval of a municipal solid waste landfill.
  • Handled numerous environmental issues relating to a foreign real estate investment trust’s purchase of 80 industrial properties worth a billion dollars; prepared all environmental provisions of the transaction documents and worked with an environmental consultant to assess properties for environmental concerns; all properties were successfully acquired.
  • Obtained substantial increase in VA benefits for Vietnam War veteran in appeal to the US Court of Appeals for Veterans Claims.
